1. About us

MelodyLetters ("we") operates the website melodyletters.com and offers personalised songs and video gifts. By using the website or placing an order, you accept these Terms. Please read them carefully before using our service.

2. Terms of use

To place an order or create an account, you must be at least 18 years old. By using our service, you confirm that you are at least 18 years old and provide true, accurate information.

3. Service

We create unique, personalised songs — and in your chosen package, video gifts too — based on the details you provide: the name of your loved one, your relationship, cherished memories and your preferred music style. Each song is created specially for your order as a personal, one-of-a-kind gift.

We offer the following products:

  • Personalised song — a unique song delivered digitally on a private gift page.
  • Song and memory film — a personalised song with a short film created from your uploaded photos.

4. Orders and payments

  • An order is created after you complete the form and submit your details.
  • Before payment, we create a preview version of the song so you can listen before deciding.
  • Your order is confirmed and accepted once payment has been processed successfully.
  • Payment is securely processed by an external provider. We do not store or have access to your card details.
  • Prices are displayed in your chosen currency during checkout and include applicable taxes, unless stated otherwise.
  • We reserve the right to cancel any order we cannot fulfil and refund the payment.

5. Delivery

  • All products are delivered digitally. After payment, you'll receive access to a private gift page with the song and, where applicable, the film.
  • Song-only orders are usually ready within a few minutes of payment. Orders including a film may take up to 24 hours.
  • You'll receive an email notification when your order is ready.
  • Delivery times are estimates. We're not responsible for delays arising from circumstances beyond our reasonable control.

6. Returns and cancellation

Our songs and films are personalised digital products, created solely for your order. Under the UK Consumer Contracts Regulations 2013 and applicable EU consumer protection laws (including Romanian OUG 34/2014), the right to cancel does not apply to:

  • digital content where delivery has begun with your express consent and you've confirmed the loss of cancellation rights upon delivery commencing; and
  • products and services that are personalised or made expressly to your specification.

By submitting your order details and requesting creation of your personalised song, you give express consent to immediate delivery of the digital service and confirm the loss of your cancellation rights upon creation commencing.

Our satisfaction guarantee. That said, we care about your satisfaction. If for any reason your order doesn't meet your expectations, get in touch with us at hello@melodyletters.com within 14 days of purchase. We'll do our best to put things right — in justified cases by recreating the song or offering a full refund at our discretion. This guarantee supplements your legal rights and doesn't override them.

7. Your materials

When using the service, you provide us with details, stories and — for film orders — photos ('Your materials'). You remain their owner. By submitting them, you grant us a limited, non-exclusive licence to use them solely to fulfil your order.

By submitting materials, you confirm that:

  • you have the right to share all materials you provide without infringing third-party rights;
  • the materials don't contain unlawful, defamatory, threatening, obscene or sexually explicit content;
  • people in any photos you submit have agreed to take part in the video gift or you have the right to act on their behalf.

We use materials solely to fulfil your order. Photos submitted for films are deleted from our systems 60 days after film delivery.

8. Permitted use

You agree not to:

  • use the service for unlawful purposes or in breach of any applicable laws;
  • submit content that is hateful, discriminatory, harassing, defamatory or sexually explicit;
  • resell, distribute or commercially exploit the song or film provided;
  • reverse engineer, copy, automatically scrape data or use any part of the platform or its systems;
  • attempt to bypass the platform's security or access controls;
  • use automated tools to place orders or interact with the service.

We reserve the right to refuse or cancel any order that we believe breaches these Terms.

9. Intellectual property

All content, software, designs and materials on melodyletters.com — except Your materials — belong to us or are licensed to us and are protected by intellectual property law. You may not reproduce, distribute or create derivative works from our platform without our written consent.

The song and film you receive are licensed for personal, private, non-commercial use. You can share them with family and friends, for example via messaging or privately on social media, but you may not sell them, sublicense them or use them commercially.

10. Limitations

The service is provided as is and as available. We aim to deliver the highest quality with every order, but music taste is subjective and we can't guarantee all expectations will be met. We'll always try to put things right — get in touch if something isn't satisfactory.

We don't guarantee uninterrupted availability of the site or the absence of errors and technical faults, but we'll take reasonable steps to minimise disruption.

11. Limitation of liability

To the maximum extent permitted by applicable law, our total liability arising from your use of the service shall not exceed the amount you paid for the relevant order.

We're not liable for indirect, incidental, special or consequential losses, including loss of profit, data or reputation, arising from your use of the service.

These Terms don't limit or exclude liability for: (a) death or personal injury caused by our negligence; (b) fraud or knowingly false statements; (c) any other liability that cannot be excluded or limited by law.

12. Governing law and disputes

These Terms are governed by and interpreted under the law of England and Wales. Any disputes arising from these Terms or your use of the service are subject to the exclusive jurisdiction of the courts of England and Wales.

If you're a consumer resident in the EU, you also have the right to bring proceedings in the courts of your country of residence.

13. Changes to these Terms

We may periodically update these Terms to reflect changes to the service, law or our practices. We'll notify you of material changes by email or a message on the site. The date at the top shows when we last updated them. Your continued use of the service after an update means you accept the revised Terms.
